29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:  (a)Hoogendoorn Construction, Inc. at 1 Bulldog Avenue, Baltic, SD 57003: On or about and at times prior to July 11, 2023, the employer did not ensure employees utilized protective head covers while exposed to such hazards as, but not limited to, unstable precast concrete wall structures, rigging equipment, and tools.  This condition exposed employees to struck-by hazards while working directly adjacent to and below precast wall erection activities.

29 CFR 1926.453(b)(2)(iv): Employees working in an aerial lift were sitting or climbing on the edge of the basket:  (a)Hoogendoorn Construction, Inc. at 1 Bulldog Avenue, Baltic, SD 57003: On or about and at times prior to July 11, 2023, the employer did not ensure that employees were protected from falls while conducting precast wall setting activities while standing and climbing on the railing of an arial lift platform located on the north side wall of a commercial building. The employee was climbing on an aerial lift platform railing which was raised more than ten feet high to gain access to an adjacent arial lift platform and employees were not using a personal fall protective system. This condition exposed the employee to fall hazards greater than ten feet.

29 CFR 1926.453(b)(2)(v): A safety harness was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift:   (a)Hoogendoorn Construction, Inc. at 1 Bulldog Avenue, Baltic, SD 57003: On or about and at times prior to July 11, 2023, the employer did not ensure that an employee was protected from falls while conducting precast wall setting activities while working from a Genie aerial lift platform, model number S-65, serial number 56011-21597, located on the north side wall of a commercial building and the employee was not using a personal fall protective system.  This condition exposed the employee to fall and ejection hazards greater than ten feet.  (b)Hoogendoorn Construction, Inc. at 1 Bulldog Avenue, Baltic, SD 57003: On or about and at times prior to July 11, 2023, the employer did not ensure that an employee was protected from falls while conducting precast wall setting activities while working from a JLG aerial lift platform, model number 450AJ, serial number 0300215425, located on the north side wall of a commercial building and the employee was not using a personal fall protective system.  This condition exposed the employee to fall and ejection hazards greater than ten feet.

This condition exposed the employee to fall hazards greater than six feet.
