29 CFR 1910.28(b)(1)(i): Except as provided elsewhere in this section 29 CFR 1910.28, the employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the systems described in 29 CFR 1910.28(b)(1)(i): (a) On or about July 5, 2023, located at 2405 West Forest Home Avenue, Milwaukee, WI 53215, employees were performing landscaping duties on the north side of the property adjacent to a retaining wall with an unprotected side that separated the property from a roadway, exposing employees to fall hazards of approximately 6 feet.

29 CFR 1904.39(a)(2): Basic Requirement. Within twenty-four (24) hours after the in-patient hospitalization of one or more employees or an employee's amputation or an employee's loss of an eye, as a result of a work-related incident, you must report the in-patient hospitalization, amputation, or loss of an eye to OSHA. (a) On or about July 5, 2023, located at 2405 West Forest Home Avenue, Milwaukee, WI 53215, the employer failed to report an in-patient hospitalization of an employee within twenty-four (24) hours. The incident occurred on July 5, 2023 at 08:30 AM and was not reported to OSHA until July 7, 2023 at 2:52 PM.
