At the worksite located at 618 Commercial Street, Atchison, Kansas, the employer did not ensure that the stairway landing and platform were at least 30 inches in depth and at least 46 inches wide, the width of the stairs. The placement of a stainless-steel table at the top of the stairway landing platform and a white rack containing cleaning product on the east wall on top of the stairs, decreased the landing platform to less than 30 inches in depth, in the direction of travel, and 46 inches wide, impeding the safe movement of employees using the stairs.

However, for any stairway used less than once per day where traffic across the stairway floor hole prevents the use of a fixed guardrail system (e.g., holes located in aisle spaces), the employer may protect employees from falling into the hole by using a hinged floor hole cover that meets the criteria in � 1910.29 and a removable guardrail system on all exposed sides, except at the entrance to the stairway.  At the worksite located at 618 Commercial Street, Atchison, Kansas; employees engaged in restaurant activities were not protected from fall hazards in that approximately 4 feet, 5 inches of a stairway floor hole is missing a guardrail system.
