29 CFR  1926.21(b)(2):The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:  a) Worksite was located at  100 North Main Street, Robbinsville, NJ 08561  A worker was exposed to struck by hazards while lifting stone slabs with a forklift that were not properly secured while they stood within the fall shadow of the slabs. The employer had not developed a formal stone slab handling and training program which would include written procedures on working with stone slabs and training all employees who work around stone slabs on the safe handling, storage and securing of the slabs on A-frames or other acceptable racks.   Violation occurred on or about July 14, 2023.

29 CFR  1926.602(d): The employer did not ensure that each employee operating a powered industrial vehicle had been trained and evaluated as required by paragraph 29 CFR 1910.178(l):  a) Worksite was located at 100 North Main Street, Robbinsville, NJ 08561  A worker was exposed to struck by hazards while lifting stone slabs to move with a forklift that was operated by an untrained operator.  Violation occurred on or about July 14, 2023.
