29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. Location: a) Worksite; Roof a) On or about 7/19/2023, the employer did not ensure that employees were protected from falling by using guardrail systems, safety net systems, and/or personal fall arrest systems. Employees walked/worked near the exposed edge of the roof, which was approximately 20 feet above the concrete sidewalk below, to perform work such as waterproofing/painting without the use of fall protection.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: Location: a) Worksite; second floor to roof; top of stairway to roof access hatch a) On or about 7/19/2023, employees used an extension ladder, that was not secured at its top, to access the roof to perform work such as waterproofing/painting. The top of the ladders side rails did not extend at least 3 feet above the edge of the roof access hatch being accessed.
