29 CFR  1926.453(b)(2)(v): A body belt (harness) was worn and a lanyard was not attached to the boom or basket when working from an aerial lift:  a)  On or about 07/18/2023,  during the renovation and painting of the Genesee County Jail, located on 14 West Main Street in Batavia, New York, the employer did not enforce the use of  fall protection for employees working in the basket of an aerial boom lift, 14 feet above lower levels.  Employees were allowed to work in an articulating boom without the proper use of Personal Fall Arrest Systems such as "tying off"  to the boom basket.    NO ABATEMENT CERTIFICATION REQUIRED
