29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(b) or (c).  a) On or about  07/24/2023, at the work site at 171 Knox Ave located in West Seneca, New York: the employer did not enforce the use of cave-in protection for employees working in a trench 5 feet 9 inches below grade.  Employees were allowed to install new mains (sewer line laterals) inside a trench with no protective systems in place.  NO ABATEMENT CERTIFICATION REQUIRED
