29 CFR  1903.19(c)(1):The employer did not certify to OSHA, within 10 calendar days after the abatement date, that the cited violation had been abated:  (a) Los Colorado Construction failed to certify abatement within 10 calendar days after the abatement date that each of the following cited violations had been corrected:  Citation 1, Item 1 a serious violation of 29 CFR  1926.20(b)(2)  with an abatement date of October 10, 2023.  Citation 1, Item 2 a serious violation of 29 CFR 1926.503(a)(1) with an abatement date of October 10, 2023.  In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATIONS OF THE CORRECTIVE ACTION WORKSHEET).

29 CFR  1926.20(b)(2): Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers.  (a) On or about July 25, 2023, at 24 Rushmore Lane, Hartford, WI 53027, frequent and regular job site inspections were not conducted to identify and correct safety hazards, including but not limited to fall hazards.

29 CFR  1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.  (a) On or about July 25, 2023, at 24 Rushmore Lane, Hartford, WI 53027, employees conducting roofing work on an existing residential home  with an approximately 6:12 pitch, were not protected from falling to the lower level. This exposed employees to a fall hazard of approximately 24 feet on the South side of the house.

29 CFR  1926.503(a)(1): The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.  (a)  On or about July 25, 2023, at 24 Rushmore Lane, Hartford, WI 53027, the employer did not ensure that employees exposed to potential fall hazards had been trained to recognize and minimize the fall hazards associated with their work.
