OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that, employees were exposed to fall and crushing hazards while riding on a John Deere Loader.  a) For the jobsite location located near 1048 Canaveral Circle, Sarasota, FL 34241, on or about 07/27/2023, the employer exposed employees to fall and crushing hazards, in that, employees rode on the sides and fork attachment of the John Deere loader, model number 204L and PIN number 1LU204LCJZB064335, while the loader was in motion.

29 CFR  1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:   a) For jobsite areas in the Grand Park housing development, on or about 07/27/2023, the employer exposed employees to struck-by and crushing hazards from the operation of a John Deere Loader, model number 204L and PIN number 1LU204LCJZB064335, in that, employees operating and working around the loader had not received training/instruction on safe operational practices, and employees rode on the side and fork attachment of the loader.  b) For jobsite areas in the Wildleaf North River Ranch housing development, on or about 08/02/2023 and at times prior to, the employer exposed employees to struck-by and crushing hazards from the operation of a John Deere Loader, model number 204L and PIN number 1LU204LCJZB064335, in that, employees operating and working around the loader had not received training/instruction on safe operational practices.

29 CFR  1926.51(a)(1): An adequate supply of potable water was not provided in all places of employment:  a) For jobsite areas in the Grand Park housing development, on or about 07/27/2023, the employer exposed employees to potential heat stress hazards, in that, water was not provided in the work place for employees. Employees had to bring their own water.  b) For jobsite areas in the Wildleaf North River Ranch housing development, on or about 08/02/2023 and at times prior to, the employer exposed employees to potential heat stress hazards, in that, water was not provided in the work place for employees. Employees had to bring their own water.
