Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that they were exposed to amputation and crushing hazards while unjamming metal pieces from a rock crushing machine:  a) On or about September 14, 2023, at O' Hare International Airport, employees were exposed to amputation and crushing hazards associated with moving parts during servicing and cleaning of the Milwaukee-Lippman 4800R crushing and screening plant magnetic conveyor.   In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement or other written records.

29 CFR  1926.1153(c)(1):  For each employee engaged in a task identified in Table 1, the employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, unless the employer assesses and limits the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section.  a) On or about September 14, 2023, at O'Hare International Airport, the employer did not fully and properly implement engineering controls and work practices as specified in Table 1. The employee was operating a Lippman-Milwaukee 4800 closed circuit impactor plant without a ventilated booth that provides fresh, climate-controlled air to the operator.

29 CFR  1926.1153(c)(2)(iii):The employer did not maintain  the enclosed cab:  a) On or about September 14, 2023, at O'Hare airport, C-pad area, the employer did not maintain the Milwaukee-Lippman 4800R crushing and screening plant operator cab;  (I) Free as practicable from settled dust; (II) Kept under positive pressure through continuous delivery of fresh air; (III) with an air intake that is filtered through a filter that is 95% efficient in the 0.3-10.0 micron range; and (IV)  with heating and cooling capabilities.  The enclosed cabin was  being used with the door opened and contained dust accumulation on the floor containing 7% of Respirable Crystalline Silica.
