29 CFR 1910.1200(h)(3)(iv): The details of the hazard communication program developed by the employer, did not include an explanation of the labels received on shipped containers and the workplace labeling system used by their employer; the safety data sheet, including the order of information and how employee could obtain and use the appropriate hazard information: (a) Kitchen - On or about July 27, 2023, Employees were required to work with hazardous chemicals, including but not limited to, Mixmate Sanitation System Non-Acid Restroom Cleaner Disinfectant, a corrosive liquid, while the employer did not ensure employees were trained on the globally harmonized system (GHS) elements such as Safety Data Sheets (SDS). In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet), in addition, documentation demonstrating the abatement is complete must be included with your certification. This documentation may include, but is not limited to evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1910.1200(j)(2)(ii): The employer did not update any alternative workplace labeling used under paragraph (f)(6) of this section, update the hazard communication program required by paragraph (h)(1), and/or provide any additional employee training in accordance with paragraph (h)(3) for newly identified physical or health hazards no later than June 1, 2016.
