On or about August 2, 2023 the employer Jeremiah Lopez DBA ADJ Construction LLC at jobsite located at 103 Shepherd Dr. Tiffin OH 44883, did not ensure that each affected employee used appropriate eye or face protection when preforming roofing work on a existing residential structure while exposed to potential struck by hazards (flying particles/debris) while using pneumatic nail guns.

29 CFR  1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system.  Or, on roofs 50-feet (15.25 m) or less in width, each employee was not protected by use of a monitoring system.  On or about August 2, 2023 the employer Jeremiah Lopez DBA ADJ Construction LLC at jobsite located at 103 Shepherd Dr. Tiffin OH 44883, did not ensure employees were protected from falls while performing roofing activities atop a low sloped commercial structure. Three employees installing new roofing shingles to the structure were exposed to falls of 12 feet and 3 tenths feet to the ground below. The roof slope was 3:12 pitch.

29 CFR  1926.1053(b)(1):Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  On or about August 2, 2023 the employer Jeremiah Lopez DBA ADJ Construction LLC at jobsite located at 103 Shepherd Dr. Tiffin OH 44883, did not ensure the side rails of one portable Werner brand aluminum extension ladder was extended at least three feet above the landing surface. Five employees were exposed to falls from approximately 12 feet or greater from the top of the second (roof) level to the decking below while using the ladder to access the second (roof) level to perform commercial roofing activities on a school building.
