29 CFR  1926.501(b)(1): "Unprotected sides and edges." Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.  a) On August 3, 2023, located throughout an 8/12 commercial roof, the employer failed to ensure that employees were utilizing an effective fall protection system while performing roofing work. As a result, employees were exposed to a fall hazard of approximately 12 feet 3 inches above ground level.

1926.502(a)(2): "General". Employers shall provide and install all fall protection systems required by this subpart for an employee, and shall comply with all other pertinent requirements of this subpart before that employee begins the work that necessitates the fall protection.  a) On August 3, 2023, the employer failed to provide and install a fall protection system before employees began roofing work on an 8/12 commercial roof. As a result, employees were exposed to a fall hazard of approximately 12 feet 3 inches above ground level.
