29 CFR  1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph.  Location: 207 Beach Road, Salisbury MA  On 8/4/2023, it was observed that the operator of the lull was not trained in the secure operation of powered industrial trucks, even though the lull was being used on-site to transport building materials from the ground to the third floor.  Instance A: A worker identified himself as the lull operator and acknowledged his lack of training in operating powered industrial trucks. The lull, located on-site, was observed lifting construction material to a height exceeding 21 feet to the third floor. Instance B: Several significant cuts were present on the lull's tires. This damage should have rendered the equipment out of service following the mandatory pre-operation check by a trained operator.

Instance A: One worker was observed standing on an assembled, yet unsecured, wall section of the third floor without fall protection before the section was raised into place. Instance B: Two workers were identified near an unprotected edge without fall protection while securing a structural beam to the floor of the third level. Instance C: One worker was seen kneeling on an unprotected edge without fall protection while assembling portions of a structural member.
