29 CFR 1910.134(c)(1):  A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use:  a) Chalk Spinner LLC,  2330 West Midway Boulevard BROOMFIELD, CO 80020 : On or about August  1, 2023, and at times prior, employees were exposed to respiratory hazards from chemicals and products such as, but not limited to; irritable wood dust, 2 2 4-Trimethyl-1 3-Pentanediol Monoisobutyrate (SPECLT QT 2PK CHALKBPARD TINTBASE), 1-Methyl-2-Pyrrolidone (MINWAX Water Based Oil-ModIfied Polyurethane Clear Satin), and 2-Methoxymethylethoxypropanol (ARPOYO 1K Waterborne Clear TopCoat Tint Base Satin) while using these chemicals in various phases of the wood treatment process. The employer required respirators but did not select the appropriate respirator in that the 3M N95 filtering face piece respirators (model 8210) was not approved for protection against arsenic as required in 1910.134(c)(1)(i).  b) Chalk Spinner LLC,  2330 West Midway Boulevard BROOMFIELD, CO 80020 : On or about August  1, 2023, and at times prior, employees were exposed to respiratory hazards from chemicals and products such as, but not limited to; irritable wood dust, 2 2 4-Trimethyl-1 3-Pentanediol Monoisobutyrate (SPECLT QT 2PK CHALKBPARD TINTBASE), 1-Methyl-2-Pyrrolidone (MINWAX Water Based Oil-ModIfied Polyurethane Clear Satin), and 2-Methoxymethylethoxypropanol (ARPOYO 1K Waterborne Clear TopCoat Tint Base Satin) while using these chemicals in various phases of the wood treatment process. The employer did not provide medical evaluations to employees required to use the respirators as required in 1910.134(c)(1)(ii).  c) Chalk Spinner LLC,  2330 West Midway Boulevard BROOMFIELD, CO 80020 : On or about August  1, 2023, and at times prior, employees were exposed to respiratory hazards from chemicals and products such as, but not limited to; irritable wood dust, 2 2 4-Trimethyl-1 3-Pentanediol Monoisobutyrate (SPECLT QT 2PK CHALKBPARD TINTBASE), 1-Methyl-2-Pyrrolidone (MINWAX Water Based Oil-ModIfied Polyurethane Clear Satin), and 2-Methoxymethylethoxypropanol (ARPOYO 1K Waterborne Clear TopCoat Tint Base Satin) while using these chemicals in various phases of the wood treatment process. The employer did not provide fit testing procedures for tight-fitting respirators to employees required to use the respirators as required in 1910.134(c)(1)(iii).  d) Chalk Spinner LLC,  2330 West Midway Boulevard BROOMFIELD, CO 80020 : On or about August  1, 2023, and at times prior, employees were exposed to respiratory hazards from chemicals and products such as, but not limited to; irritable wood dust, 2 2 4-Trimethyl-1 3-Pentanediol Monoisobutyrate (SPECLT QT 2PK CHALKBPARD TINTBASE), 1-Methyl-2-Pyrrolidone (MINWAX Water Based Oil-ModIfied Polyurethane Clear Satin), and 2-Methoxymethylethoxypropanol (ARPOYO 1K Waterborne Clear TopCoat Tint Base Satin) while using these chemicals in various phases of the wood treatment process.  The employer did not provide procedures for proper use of respirators in routine and reasonably foreseeable emergency situations for tight-fitting respirators to employees required to use the respirators as required in 1910.134(c)(1)(iv).  e) Chalk Spinner LLC,  2330 West Midway Boulevard BROOMFIELD, CO 80020 : On or about August  1, 2023, and at times prior, employees were exposed to respiratory hazards from chemicals and products such as, but not limited to; irritable wood dust, 2 2 4-Trimethyl-1 3-Pentanediol Monoisobutyrate (SPECLT QT 2PK CHALKBPARD TINTBASE), 1-Methyl-2-Pyrrolidone (MINWAX Water Based Oil-ModIfied Polyurethane Clear Satin), and 2-Methoxymethylethoxypropanol (ARPOYO 1K Waterborne Clear TopCoat Tint Base Satin) while using these chemicals in various phases of the wood treatment process. The employer did not provide procedures for cleaning, disinfecting, storing, inspecting, repairing, discarding, and otherwise maintaining respirators of employees required to use the respirators as required in 1910.134(c)(1)(v).  f) Chalk Spinner LLC,  2330 West Midway Boulevard BROOMFIELD, CO 80020 : On or about August  1, 2023, and at times prior, employees were exposed to respiratory hazards from chemicals and products such as, but not limited to; irritable wood dust, 2 2 4-Trimethyl-1 3-Pentanediol Monoisobutyrate (SPECLT QT 2PK CHALKBPARD TINTBASE), 1-Methyl-2-Pyrrolidone (MINWAX Water Based Oil-ModIfied Polyurethane Clear Satin), and 2-Methoxymethylethoxypropanol (ARPOYO 1K Waterborne Clear TopCoat Tint Base Satin) while using these chemicals in various phases of the wood treatment process. The employer did not provide procedures to ensure adequate air quality, quantity, and flow of breathing air for atmosphere-supplying respirators for employees required to use the respirators as required in 1910.134(c)(1)(vi).  g) Chalk Spinner LLC,  2330 West Midway Boulevard BROOMFIELD, CO 80020 : On or about August  1, 2023, and at times prior, employees were exposed to respiratory hazards from chemicals and products such as, but not limited to; irritable wood dust, 2 2 4-Trimethyl-1 3-Pentanediol Monoisobutyrate (SPECLT QT 2PK CHALKBPARD TINTBASE), 1-Methyl-2-Pyrrolidone (MINWAX Water Based Oil-ModIfied Polyurethane Clear Satin), and 2-Methoxymethylethoxypropanol (ARPOYO 1K Waterborne Clear TopCoat Tint Base Satin) while using these chemicals in various phases of the wood treatment process. The employer did not provide training of employees in the respiratory hazards to which they are potentially exposed during routine and emergency situations for employees required to use the respirators as required in 1910.134(c)(1)(vii).  h ) Chalk Spinner LLC,  2330 West Midway Boulevard BROOMFIELD, CO 80020 : On or about August  1, 2023, and at times prior, employees were exposed to respiratory hazards from chemicals and products such as, but not limited to; irritable wood dust, 2 2 4-Trimethyl-1 3-Pentanediol Monoisobutyrate (SPECLT QT 2PK CHALKBPARD TINTBASE), 1-Methyl-2-Pyrrolidone (MINWAX Water Based Oil-ModIfied Polyurethane Clear Satin), and 2-Methoxymethylethoxypropanol (ARPOYO 1K Waterborne Clear TopCoat Tint Base Satin) while using these chemicals in various phases of the wood treatment process.
