29 CFR 1915.15(e): After a competent person conducted a visual inspection and tests and determined a space to be safe for an employee to enter, he or she did not continue to test and visually inspect spaces as often as necessary to ensure that the required atmospheric conditions within the tested space were maintained: a) Steel America Structural Weld Shop: On or about August 03, 2023, the employer failed to test and inspect the caisson confined spaces as often as necessary, as a result, the space filled with welding fumes thereby reduced visibility and potentially overexposed employees to toxic welding fumes. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

Note: The employer is to make this determination in accordance with either paragraph (d)(2), the scheduled monitoring option, or paragraph (d)(3), the performance-oriented option. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1915.71(b)(5): Scaffolds were not maintained in a safe and secure position: a) Steel America Structural Weld Shop Caisson: On or about August 07, 2023, tube and coupling scaffolding systems were not maintained in a safe and secure position in that wooden scaffold planks were loose and not secured thereby exposed employees to an 8-ft fall hazard. b) Steel America Structural Weld Shop Caisson: On or about August 07, 2023, tube and coupling scaffolding systems were not maintained in a safe and secure position in that the distance between wooden scaffold planks exceeded 1 inch thereby exposed employees to possible struck-by hazards resulting from scaffold poles and other items falling between boards. c) Steel America Structural Weld Shop Caisson: On or about August 07, 2023, tube and coupling scaffolding systems were not maintained in a safe and secure position in that electrical wires, welding cables, broom sticks, carbon arc rods and other items created trip and slip hazards. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1910.334(a)(2)(i): Portable cord and plug connected equipment and flexible cord sets (extension cords) were not visually inspected before use on any shift for external defects (such as loose parts, deformed and missing pins, or damage to outer jacket or insulation) and for evidence of possible internal damage (such as pinched or crushed outer jacket): a) Steel America Structural Weld Shop: On or about August 08, 2023, a visual inspection of the portable electrical ventilation blower placed on top of the caisson was not conducted before use in that the flexible cord to the blower was pulled away from its housing causing strain on the internal electrical connections and possible burns to employees resulting from electrical shock. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
