29 CFR 1910.134(c)(2)(ii): The employer did not establish and implement those elements of a written program necessary to ensure that any employee using a respirator voluntarily was medically able to use that respirator, and that the respirator was cleaned, stored, and maintained so that its use does not present a health hazard to the user:  At a worksite located at 1204 W 27th Street, Kansas City, MO:   Employees were exposed to health hazards in the form of potential respiratory hazards. This was demonstrated on or about August 14, 2023, and at times prior to when employees were permitted to use a tight-fitting respirator and the employer had not established and implemented necessary elements of a written respiratory protection program concerning voluntary use of respirators.

29 CFR 1910.134(k)(6): The employer did not provide the basic advisory information on respirators, as presented in Appendix D of 29 CFR 1910.134, in written or oral format to employees who wear respirators when such use was not required by the employer:  At a worksite located at 1204 W 27th Street, Kansas City, MO:   The employer failed to protect employees from respiratory hazards; including but not limited to dermatitis, allergic respiratory effects, and mucosal and nonallergic respiratory effects. This was most recently demonstrated on or about August 14, 2023, and at times prior to, when employees wore a tight-fitting elastomeric respirator and had not been provided with a copy of Appendix D of the respiratory protection standard.

This was most recently demonstrated on or about August 14, 2023, and at times prior to, when employees wore a tight-fitting elastomeric respirator and had not been medically evaluated prior to use of the respirator.
