E7 Subcontractors LLC, located at 733 Hebron Rd, Heath, OH 43056: On and about August 17, 2023, the employer failed to initiate and maintain a safety and health program such as, but not limited to, a fall protection program for employees conducting framing work.

29 CFR 1926.503(a)(1): The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards: a. E7 Subcontractors LLC, located at 733 Hebron Rd, Heath, OH 43056: On and about August 17, 2023, the employer did not ensure employees were trained on the recognition of fall hazards or the procedures required to be followed to minimize the fall hazards. Employees, without fall protection training, were conducting framing activities while working from an elevated aerial lift platform without the harness being connected. Thereby being exposed to a 22-foot fall hazard.

29 CFR 1926.453(b)(2)(v): A body belt shall be worn and a lanyard attached to the boom or basket when working from an aerial lift: Note to paragraph (b)(2)(v): As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under 1926.502(e). a. E7 Subcontractors LLC, located at 733 Hebron Rd, Heath, OH 43056: On and about August 17, 2023, the employer did not ensure that employees engaged in construction activities using an aerial lift were protected from falls. A framer was working from an elevated aerial lift platform without their harness being connected. Thereby being exposed to a 22-foot fall hazard.
