The path to ground from circuits, equipment, and enclosures shall be permanent, continuous, and effective. a) On or before August 16, 2023, the employer failed to ensure that the electrical ground for the EBB-460B (Serial No. H4012639) Heater was permanent, continuous, and effective in that the grounding wire was disconnected resulting in employees exposure to shock.

29 CFR 1910.303(b)(1): Examination. Electric equipment shall be free from recognized hazards that are likely to cause death or serious physical harm to employees. Safety of equipment shall be determined using the following considerations: (ii) Mechanical strength and durability, including, for parts designed to enclose and protect other equipment, the adequacy of the protection thus provided; (viii) Other factors that contribute to the practical safeguarding of persons using or likely to come in contact with the equipment. a) On or before August 16, 2023, the employer failed to ensure that electrical equipment, such as the grounding wire for the EBB-460B (Serial No. H4012639), was free of recognized hazards in that the grounding wire was disconnected exposing the employees to shocking hazards.

Within twenty-four (24) hours after the in-patient hospitalization of one or more employees or an employee's amputation or an employee's loss of an eye, as a result of a work-related incident, you must report the in-patient hospitalization, amputation, or loss of an eye to OSHA. a) On or about August 16, 2023, the employer failed to report within 24 hours an employee's hospitalization due to a shock that occurred at a residential home located at 9845 Harrison Avenue, Harrison, OH 45030.
