29 CFR  1910.95(d)(1): When information indicated that any employee's exposure equaled or exceed the 8-hour time-weighted average of 85 decibels, the employer did not develop and implement a monitoring program:  On or about August 30, 2023, and at times prior thereto, employees were exposed to hazardous noise levels without the development and implementation of a noise monitoring program, exposing them to hazardous noise levels in the following instances (a-c):  a. An employee was exposed to continuous sound levels of 87 dBA, equivalent to 86% of the allowable 50% dose for an 8-hour time-weighted average (TWA). Exposure was derived from a sample collected over 370 minutes, and zero valve exposure was assumed from a 110-minute non-sampled period.  b. An employee was exposed to continuous sound levels of 87 dBA, equivalent to 91% of the allowable 50% dose for an 8-hour time-weighted average (TWA). Exposure was derived from a sample collected over 361 minutes, and zero valve exposure was assumed from a 119-minute non-sampled period.  c. An employee was exposed to continuous sound levels of 86 dBA, equivalent to 73% of the allowable 50% dose for an 8-hour time-weighted average (TWA). Exposure was derived from a sample collected over 353 minutes, and zero valve exposure was assumed from a 127-minute non-sampled period.

29 CFR  1910.95(i)(2)(ii)(A): The employer did not ensure that hearing protectors are worn by any employee who is exposed to an 8-hour time-weighted average of 85 decibels or greater and has not yet had a baseline audiogram established pursuant to 29 CFR 1910.95(g)(5)(ii):  On or about August 30, 2023, and at times prior thereto, employees without baseline audiograms were not wearing hearing protection when exposed to hazardous noise levels in the following instances (a-c):  a. An employee was exposed to continuous sound levels of 87 dBA, equivalent to 86% of the allowable 50% dose for an 8-hour time-weighted average (TWA). Exposure was derived from a sample collected over 370 minutes, and zero valve exposure was assumed from a 110-minute non-sampled period.  b. 29 CFR  1910.212(a)(3)(ii): The  point of operation of machines whose operation exposed an employee to injury, was not guarded:   On or about August 23, 2023, and at times prior thereto, employees operated a Hobart vertical band saw that was not properly guarded while cutting frozen meat, exposing them to struck-by hazards.
