The employee was using a Bobcat Excavator to support a home made scaffold platform and the employer did not ensure the platform was designed by the manufacturer.

29 CFR 1926.454(a): The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards. On or about August 8, 2023, an employee was exposed to a fall of approximately 16 feet while performing balcony repairs on an apartment building located at 4809 Columbia Road, North Olmsted, Ohio 44070. The employee was using a Bobcat Excavator to support a home made scaffold platform and the employer did not ensure the employees were trained by a qualified person on how to recognize and minimize fall hazards.
