29 CFR  1926.20(b)(1): The employer failed to initiate and maintain such programs as may be necessary to comply with the prevention of accidents at their worksite.  On or about September 5, 2023 the employer did not have a program in place to identify hazards found on the job site. This program assists employees in maintaining a safe working environment by identifying potential hazards they can encounter in their tasks including, but not limited to, falls from the roof during jobsite roofing operations.

29 CFR  1926.503(a)(1): The employer did not provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards:  On or about September 5, 2023, the employer, working at the address of 15439 Wapakoneta Road in Grand Rapids, Ohio, did not ensure their employees had been properly trained on how to use appropriate fall protection systems including but not limited to a guardrail system, safety net system, personal fall arrest system, or alternative fall protection measures while conducting roofing operations including but not limited to placing metal roofing material on the second roof of a residential home.

29 CFR  1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, personal fall arrest system, or provided with an alternative fall protection measure under another provision of paragraph 1926.501:  On or about September 5, 2023, the employer, working at the address of 15439 Wapakoneta Road in Grand Rapids, Ohio, did not ensure their employees were protected from fall hazards using a guardrail systems, safety net system, personal fall arrest system, or an alternative fall protection measure. Employees were securing metal roofing material to the second floor roof of a two story residential home without the use of fall protection, exposing employees to falls hazards of approximately 20 feet.

29 CFR  1926.1053(b)(1): When portable ladders are used for access to an upper landing surface, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grabrail, shall be provided to assist employees in mounting and dismounting the ladder. In no case shall the extension be such that ladder deflection under a load would, by itself, cause the ladder to slip off its support:  On or about September 5, 2023, the employer of JMS Exteriors LLC working at the site address of 15439 Wapakoneta Road in Grand Rapids, Ohio, did not ensure that a portable ladder that employees used to gain access to the second floor roof extended at least  three feet above the edge of the second floor roof. Employees using the ladder to get on and off the second story roof were exposed to falls hazards by falling off of the ladder by either losing their balance or having the ladder tip over or move down the slope of the first floor roof.
