OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falls.  Location: 239 Main St Route 28, DENNISPORT, MA  On September 5, 2023, employees were exposed to fall hazards of up to 20 feet while using a ladder platform shingle hoist to access the roof. The hoist was not designed to be used in place of a ladder and was not equally supported as it rested against the side of the building and the materials hoist side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:

29 CFR  1926.501(b)(1):Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.  Location: Jobsite 239 Main St Route 28, DENNISPORT, MA   On September 5, 2023, employees were exposed to falls from heights up to 20 feet to the ground while working on a commercial 8-12 pitch roof during a roofing project where fall protection was not utilized.
