29 CFR  1926.21(b)(2):The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:  Site- An employee exposed to struck by hazards while directing traffic from within the traveled way, at an intersection, was not provided with temporary traffic control, signaling, and flagger training from the employer.

29 CFR  1926.201(a): Signaling by flaggers and the use of flaggers, including warning garments worn by flaggers did not conform to Part VI of the Manual on Uniform Traffic Control Devices 2009 Edition:   Site- An employee directing traffic was not protected from struck by hazards where the temporary traffic control procedure in place did not conform to Part VI of the Manual on Uniform Traffic Control Devices 2009 Edition.  The employee directing traffic was not wearing high-visibility clothing; was flagging from within the traveled way; was not using a stop/slow paddle, flag, or automated flagger assistance device; and advance warning signs, including lane closure signs, were not in place.
