29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards: (a) On or about September 11, 2023, the employer did not ensure that each employee engaged in roofing operations was trained to recognize the hazards of working at elevation and trained in the use of fall protection. Employees did not utilize fall protection when they removed and installed shingles on a three-story residential property, with a roof slope of 4-in-12. This condition exposed employees of injuries associated with falls from heights of approximately 30 feet. Abatement Note: As of January 1, 1998, Subpart M of the 29 CFR 1926 part 1926.502(d) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under 1926.502(e). Abatement Note: The employer shall assure that each employee has been trained, as necessary, by a competent person qualified in the following areas: a) The nature of fall hazards in the work area; b) The correct procedures for erecting, maintaining, disassembling, and inspecting the fall protection systems to be used; c) The use and operation of guardrail systems, personal fall arrest systems, safety net systems, warning line systems, safety monitoring systems, controlled access zones, and other protection to be used; d) The role of each employee in the safety monitoring system when this system is used; e) The limitations on the use of mechanical equipment during the performance of roofing work on low-sloped roofs; f) The correct procedures for the handling and storage of equipment and materials and the erection of overhead protection; and g) The role of employees in fall protection plans; h) The standards contained in this subpart.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: (a) On or about September 9, 2023, the employer did not ensure that extension ladders had side rails extending 3 feet above the top balcony rail or were secured when accessing second level balcony. Employees exited extension ladders and climbed over a balcony rail to access the balcony. In addition, employees climbed over balcony rails to access extension ladders. This condition exposed employees to fall hazards of approximately 25 feet to the ground below.

29 CFR 1926.1060(a): The employer did not provide a training program for each employee using ladders and stairways, as necessary, which would enable each employee to recognize hazards related to ladders and stairways and train each employee in the procedures to be followed to minimize these hazards: (a) On or about September 9, 2023, the employer did not provide a training program, for each employee using ladders, to train each employee in the procedures to be followed to minimize hazards related to ladders, in that employees used a series of ladders to access a three-story residential structure, via the structure's roofs and balcony. Employees exited extension ladders and climbed over balcony rails to access balconies. In addition, employees climbed over balcony rails to access extension ladders. This condition exposed employees to fall hazards of 12 to 30 feet to the ground below. Abatement Note: The employer shall ensure that each employee has been trained by a competent person in the following areas, as applicable: (a) The nature of fall hazards in the work area; (b) The correct procedures for erecting, maintaining, and disassembling the fall protection systems to be used; (c) The proper construction, use, placement, and care in handling of all stairways and ladders; (d) The maximum intended load-carrying capacities of ladders; and (e) The standards contained in this subpart.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m), or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501(b): (a) On or about September 9, 2023, the employer did not ensure that employees were protected from injury, in that three employees removing and installing shingles on a three-story residential home, with a roof pitch of approximately 4-in-12, were not utilizing a fall protection system. This condition exposed employees of approximately 30 feet (9.1 m). Shark Construction Ltd. was previously cited for a violation of the same or substantially similar condition of this Occupational Safety and Health Standard 29 CFR 1926.501(b)(13) which was contained in OSHA Inspection Number 1416803, Citation Number 1 Item 1 issued on September 3, 2019, and became Final Order on September 25, 2019, with respect to a workplace located at 13052 Spruce Pl., Thornton, CO 80602.
