29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:  a.  At 26 Ocean Street, Palm Coast, FL; On or about September 13, 2023, the employer exposed an employee to a head injury hazard from the bucket of the excavator in that the employee was not wearing a hard hat while working next to the excavator.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section:  a.  At 26 Ocean Street, Palm Coast, FL; On or about September 13, 2023, the employer exposed employees to a cave-in hazard in the 7 foot deep excavation in that no cave-in protective system was used.
