29 CFR 1910.1200(e)(1): The employer had not developed or implemented a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met, and which also includes the requirements outlined in 29 CFR 1910.1200(e)(1)(i) and (e)(1)(ii): (a) Mechanic Shop of BMW of Springfield, 391 US-22, Springfield, NJ 07081 On or about September 22, 2023, and thereafter, a written plan was not developed & implemented for communication of chemical hazards to the employee(s) who use them. Shop employee(s) use chemical products such as Wurth High Heat Spray Paint, DT-5 virgin lacquer thinner and ALB 9900 Grease Remover that present flammability and respiratory irritant hazard properties.

29 CFR 1910.134(c)(2)(ii): The employer did not establish and implement those elements of a written program necessary to ensure that any employee using a respirator voluntarily was medically able to use that respirator, and that the respirator was cleaned, stored, and maintained so that its use does not present a health hazard to the user: (a) Mechanic Shop of BMW of Springfield, 391 US-22, Springfield, NJ 07081 On or about September 22, 2023, and thereafter, employees who voluntarily wore a respirator were not provided a medical evaluation to determine their ability to use a respirator before use. Employees were also not provided training to ensure that the respirator was cleaned, stored, and maintained correctly so that its use did not present a health hazard.
