29 CFR 1910.132(a): Personal protective equipment was not provided and used whenever hazards capable of causing injury or impairment were encountered:  At the worksite located at 2208 Birch Drive, Kansas City, Kansas 66101, employees engaged in landscaping activities including, but not limited to mowing, were exposed to struck-by, slips, and amputation hazards. The employer did not ensure that adequate personal protective equipment (PPE) such as but not limited to slip-resistant footwear was provided and required for use by employees while operating the Wright Stander X lawn mower.

29 CFR 1910.132(d)(2): The employer shall verify that the required workplace hazard assessment has been performed through a written certification that identifies the workplace evaluated; the person certifying that the evaluation has been performed; the date(s) of the hazard assessment; and, which identifies the document as a certification of hazard assessment.  At the worksite located at 2208 Birch Drive, Kansas City, Kansas 66101, The employer did not produce, upon request, a written certification demonstrating that a workplace hazard assessment had been performed to determine the type of personal protective equipment needed for employees engaged in landscaping activities, exposing employees to falls, lacerations, and amputations hazards.

29 CFR 1904.39(a)(2): The employer did not report an in-patient hospitalization, amputation, or loss of an eye as a result of a work-related incident to OSHA within twenty-four (24) hours.   Woodland Lawn and Landscaping Inc., located at 301 S. 59th Lane, Kansas City, Kansas, 66111, did not report an amputation as a result of a work-related incident to OSHA within twenty-four hours. An incident occurred on or about September 8, 2023, which involved a partial amputation of a right foot's big toe and a 14-inch laceration under the foot, and the incident was not reported to OSHA until September 20, 2023.
