OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm in that employees were exposed to struck-by, crushed-by and/or electrical hazards:   a) Masser LLC dba Masser Metals and Recycling located at 3103 Lamb Ave, Columbus, OH 43219: On or about October 3, 2023, and at times prior, employees were exposed to stuck-by, crushed-by and electrical hazards while walking/working in the vicinity of and operating a Komatsu Hydraulic Excavator Model PC 300 LC-6LL that was equipped with an electrically operated Walker Scrap Series Magnet used to move scrap materials throughout the steel yard.  The employer failed to ensure that the modification did not impair the proper functions and safety of the equipment by obtaining authorization from Komatsu.
