29 CFR  1926.102(a)(1): Employees did not use eye and face protection equipment when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents:  a) Roof: On or about 10/3/2023, the employer exposed employees to struck-by hazards while installing plywood sheathing, in that protective eyewear was not provided to employees engaged in framing activities using pneumatic guns at 120 PSI.

29 CFR  1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:    a) Roof front: On or about 10/3/2023, the employer exposed employees to fall hazards of approximately 24-feet, 8-inches to the lower ground level, in that the use of personal fall protection was not enforced while performing framing activities while standing on the trusses.  b) Second floor back side:  On or about 10/3/2023, the employer exposed employees to fall hazards of approximately 22-feet to the lower ground level, in that the use of personal fall protection was not enforced while performing framing activities.

29 CFR  1910.178(l)(4)(iii): An evaluation of each powered industrial truck operator's performance was not being conducted at least once every three years:  a) Front side of townhome/Roof: On or about 10/3/2023, the employer exposed employees to struck-by hazards while operating the JLG Skytrack S/N 309557, in that the operator was not provided refresher training since license expiration on 05/2023.
