29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator was competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):  (a)Karl's TV & Appliance Inc. at 1615 North Harrison Avenue, Suite 3, Pierre, SD 57501:  On or about and at times prior to October 5, 2023, the employer did not ensure that employees were trained on how to operate powered industrial trucks ("PIT") prior to operation with the Big Joe Model No. S-30-128. This condition exposed employees to injuries associated with improper powered industrial truck operations.

29 CFR  1910.178(l)(6): The certification did not include the name of the operator, the date of the training, the date of the evaluation, and the identity of the person(s) performing the training or evaluation:   (a)Karl's TV & Appliance Inc. at 1615 North Harrison Avenue, Suite 3, Pierre, SD 57501:  On or about and at times prior to October 5, 2023, the employer did not ensure that a written certification/ evaluation was conducted prior to employees utilizing powered industrial trucks on site.  This condition exposed employees to injuries associated with improper powered industrial truck operations.
