OSH ACT of 1970 Section (5)(a)(1): OSH ACT of 1970 SECTION (5)(a)(1): The employer did not furnish employment and  a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by/caught between hazards associated storage rack anchor bolt deficiencies:  A.)  Penn-Union Co. LLC on or about October 11, 2023 at the address of, 229 Waterford Street, Edinboro, PA: Main shop storage racks on or about October 11, 2023 and times prior thereto: the storage rack systems in the main shop were not installed correctly in that anchor bolts had not been installed to secure the racks to the floor.  ABATEMENT CERTIFICATION AND DOCUMENTATION REQUIRED: Abatement certification is required within 15 days after the abatement date noted on the citation. This certification shall include a statement that abatement is complete, the date abatement was completed, method of abatement, and state that employees and their representatives were informed of this abatement. IN ADDITION, abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic, or video evidence or abatement or other written records.

LLC, on or about October 06, 2023 at the address of 229 Waterford Street, Edinboro, PA: An employee was operating the V&O Punch Press #104 without a guard covering the point of operation. The employee suffered a finger amputation as a result of the unguarded punch press.

29 CFR  1910.217(c)(2)(i)(b): Point of operation guard(s) on mechanical power press(es) did not conform to the maximum permissible opening(s) specified in Table 10 O-10:   A) Penn-Union Co. on or about October 11, 2023 at the address of 229 Waterford Street, Edinboro, PA: An employee was operating the V&O Punch Press #104 with a fixed guard that did not conform to table O-10. The opening on the bottom of the guard was 1.5 inches, with a distance of 6.5 inches to the point of operation, table O-10 only allows an opening of 7/8 of an inch.

LLC, on or about October 11, 2023 at the address of 229 Waterford Street, Edinboro, PA: An employee was operating the V&O Punch Press #104 with a guard that created a pinch point with the ram of the machine. The top of the guard created a pinch point between the ram and the guard.
