29 CFR  1910.134(c)(1):  A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use:   On or about October 12, 2023, and at times prior thereto, employees grinding and polishing quartz material were required to wear a respirator, exposing employees to an undue physiological burden and to unforeseen medical issues. The employer did not implement a written respiratory protection program to include, but not limited to, the following (a-d):  a) Ensuring employees were medically cleared to wear a respirator. b) Ensuring employees were fit tested for respirators used. c) Ensuring only NIOSH-certified respirators were provided for use. d) Training on the proper use and care of respirators.

29 CFR 1904.29(a): Basic requirement. You must use OSHA 300, 300-A, and 301 forms, or equivalent forms, for recordable injuries and illnesses. The OSHA 300 form is called the Log of Work-Related Injuries and Illnesses, the 300-A is the Summary of Work-Related Injuries and Illnesses, and the OSHA 301 form is called the Injury and Illness Incident Report.   On or about October 12, 2023, the employer did not maintain or have available OSHA 300, 301, 300A or equivalent forms for recording injuries and illnesses of employees at Fox River Granite & Marble.
