29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use: On or about October 12, 2023, and at times prior thereto, employees grinding and polishing quartz material were required to wear a respirator, exposing employees to an undue physiological burden and to unforeseen medical issues. The employer did not implement a written respiratory protection program to include, but not limited to, the following (a-d): a) Ensuring employees were medically cleared to wear a respirator. b) Ensuring employees were fit tested for respirators used. c) Ensuring only NIOSH-certified respirators were provided for use. d) Training on the proper use and care of respirators.
