29 CFR  1910.147(d): Application of control. The established procedures for the application of energy control (the lockout or tagout procedures) shall cover the following elements and actions and shall be done in the following sequence:  At a facility located at 7811 County Road D in Waupaca, Wisconsin, the employer did not ensure that employees implemented energy control application steps or equipment protective measure prior to allowing them to perform work on equipment such as the following:  a) On October 18, 2023, an employee was observed working on the shanklin machine and did not utilize a lockout/tagout device.  b) On October 18, 2023, an employee was observed working on the mixer and did not utilize a lockout/tagout device.  c)   On October 18, 2023, the employer did not protect the employees from hazards associated with moving parts while entering a spiral freezer while the freezer is operating and not performing lockout/tagout.   As a result, the remaining applicable energy control elements, involving machine isolation [(d)(3)], LOTO device application [(d)(4)], dissipation of residual energy [(d)(5)(i)], and verification of isolation [(d)(6)], were not implemented to protect employees from machine hazards.

29 CFR 1910.212(a)(1): Types of guarding. One or more methods of machine guarding shall be provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks. Examples of guarding methods are-barrier guards, two-hand tripping devices, electronic safety devices, etc.  At an establishment located at 7811 County Road D in Waupaca, Wisconsin, employees of Bernatello's Pizza, Inc. were not provided machine guarding to protect operators and other employees in the machine areas from hazards, such but not limited to:  a)  On or about November 1, 2023, the employer did not protect employees from the ingoing nip points on the pie press on line 1.  Lower guard on the pie press to ? inch opening above pie pan, no later than April 12, 2024.   b) On or about November 1, 2023, the employer did not protect employees from the ingoing nip points on the dough roller on line 1. Add a second bar to the dough roller to increase distance from feed, no later than April 12, 2024.  c) On or about October 18, 2023, the employer did not protect employees from the nip point on the tex-wrap machine. Add plexiglass tunnels to the tex-wrap machine entry and exit, no later than April 12, 2024.

29 CFR  1910.219(c)(2)(i): All exposed parts of horizontal shafting seven (7) feet or less from floor or working platform, excepting runways used exclusively for oiling, or running adjustments, shall be protected by a stationary casing enclosing shafting completely or by a trough enclosing sides and top or sides and bottom of shafting as location requires.  At an establishment located at 7811 County Road D in Waupaca, Wisconsin, employees of Bernatello's Pizza, Inc. were not provided adequate guarding to protect operators and other employees in the machine areas from hazards, such but not limited to:  a) On or about October 18, 2023, the employer did not protect employees from the exposed horizontal motor shafting for the crust placing conveyor on line 2.  Nip Point.  b) On or about October 18, 2023, the employer did not protect employees from the exposed horizontal shafting for a roller on the mushroom saver on line 2.   Nip Point.  c) On or about October 18, 2023, the employer did not protect employees from the exposed horizontal motor shafting for the conveyor after the second cheese applicator on line 2.  Nip Point.  d) On or about October 18, 2023, the employer did not protect employees from the exposed horizontal motor shafting for a conveyor on line 2 leading to the spiral freezer.  Nip Point.  e) On or about October 18, 2023, the employer did not protect employees from the exposed horizontal motor shafting for the conveyor after pizza boxing on line 2. Nip Point.  f) On or about October 18, 2023, the employer did not protect employees from the exposed horizontal motor shafting for the meat saver return conveyor on line 2.  g) On or about October 18, 2023, the employer did not protect employees from the ingoing nip points on the conveyor for the sauce applicator on line 2.  h) On or about October 18, 2023, the employer did not protect employees from the ingoing nip points on the cheese saver conveyor on line 2.  i) On or about October 18, 2023, the employer did not protect employees from the ingoing nip points on a box packaging machine conveyor on the packaging line.

29 CFR  1910.219(f)(3): Sprockets and chains. All sprocket wheels and chains shall be enclosed unless they are more than seven (7) feet above the floor or platform. Where the drive extends over other machine or working areas, protection against falling shall be provided. This subparagraph does not apply to manually operated sprockets.  At an establishment located at 7811 County Road D in Waupaca, Wisconsin, employees of Bernatello's Pizza, Inc. were not provided adequate guarding to protect operators and other employees from the chain and sprocket on the cheese applicator on line 2.
