29 CFR  1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person(s)  a) 16 Nicholas Drive, Lexington Glen, Dover, DE 19901: On or about 10/18/2023, a competent person did not initiate or maintain frequent and regular inspections of the job site, materials and equipment.  Employees were not provided with or used a mask, hearing protection or wet methods while operating a Stihl chop saw to cut concrete blocks for a walkway.

29 CFR  1926.102(a)(2): The employer did not ensure that each affected employee used eye protection that provides side protection when there is a hazard from flying objects. Detachable side protectors (e.g. clip-on or slide-on side shields) meeting the pertinent requirements of this section are acceptable:  a) 16 Nicholas Drive, Lexington Glen, Dover, DE 19901: On or about 10/18/2023, employee(s) observed operating a Stihl Chop saw without eye/face protection while cutting concrete blocks for a paver walkway.

29 CFR  1926.1153(c)(2)(ii): Water was not applied at flow rates sufficient to minimize release of visible dust for tasks performed using wet methods:  a) 16 Nicholas Drive, Lexington Glen, Dover, DE 19901: employees observed operating a Stihl chop saw without the use of wet methods. During the operation the employee did not have on eye protection, hearing protection, a face shield or an adequate mask and exposed to concrete dust clouds.
