29 CFR  1910.132(d)(2): The employer did not verify that the required workplace hazard assessment had been performed through a written certification that identifies the workplace evaluated; the person certifying that the evaluation has been performed; the date(s) of the hazard assessment; and, which identified the document as a certification of hazard assessment.  On or about October 19, 2023, James Kelly DBA Wild Animal Adventure Park, LLC did not verify the workplace hazard assessment had been performed through a written certification that identifies the workplace at 2719 North Service Road East in Sullivan, Missouri had been evaluated; the person certifying that the evaluation had been performed; the date(s) of the hazard assessment; and, which was identified as a certification of hazard assessment.

29 CFR  1910.1200(e)(1): Employers had not developed, implemented, and maintained at each workplace, a written hazard communication program which at least described how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training would be met.  On or about October 19, 2023, and prior thereto, James Kelly DBA Wild Animal Adventure Park, LLC did not develop, implement, and maintain at at 2719 North Service Road East in Sullivan, Missouri, a written hazard communication program which at least described how the criteria specified in paragraphs (f) for labels and other forms of warning, (g) for safety data sheets, and (h) for employee information and training would be met.
