29 CFR  1910.1200(e)(1):Employers shall develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met:  On or about October 19, 2023, the employer did not implement and maintain a written hazard communications program addressing Labeling, Safety Data Sheets and Training, exposing employees to hazardous chemicals such as Portland cement and Silica.  Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR  1926.100(a):Employees working in areas where there is a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns, shall be protected by protective helmets.  On or about October 19, 2023, employees performing masonry operations were not wearing hard hats, exposing the employees to struck-by hazards.  Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR  1926.451(b)(1):Each platform on all working levels of scaffolds shall be fully planked or decked between the front uprights and the guardrail supports as follows:  On or about October 19, 2023, the working platform of scaffolds were not fully planked or decked between the uprights, exposing the employee to a fall of approximately 12.7 feet.  Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR  1926.451(g)(1):Each employee on a scaffold more than 10 feet (3.1 m) above a lower level shall be protected from falling to that lower level. Paragraphs (g)(1)(i) through (vii) of this section establish the types of fall protection to be provided to the employees on each type of scaffold. Paragraph (g)(2) of this section addresses fall protection for scaffold erectors and dismantlers. Note to paragraph (g)(1): The fall protection requirements for employees installing suspension scaffold support systems on floors, roofs, and other elevated surfaces are set forth in subpart M of this part.  On or about October 19, 2023, employees working from a metal frame scaffold were not protected from a fall, exposing employees to a fall of 12.7 feet.   Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR  1926.451(e)(1):When scaffold platforms are more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface shall be used. Cross braces shall not be used as a means of access.  On or about October 19, 2023, employees working on a metal frame scaffold were not using a safe means of access, exposing the employee to the hazards associated with no safe access to a scaffold.  Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).
