29 CFR 1910.28(b)(1)(i):  Except as provided elsewhere in this section 29 CFR 1910.28, the employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the systems described in 29 CFR 1910.28(b)(1)(i):   a. 596 Belgrove Drive, Kearny, NJ  On or about October 16, 2023, the employer did not ensure that an employee working from heights was protected from falls as employee performed gutter repair on an unprotected roof surface, and was exposed to fall hazards of 8 feet or more.

29 CFR  1910.30(a)(1): The employer did not provide training for each employee exposed to fall hazards and who used personal fall protection systems or is required to be trained as specified elsewhere in this subpart:  a. 596 Belgrove Drive, Kearny, NJ  On or about October 16, 2023, the employer did not ensure that an employee working from heights was adequately trained in the recognition and avoidance of fall hazards. The employee was exposed to a 8 foot fall hazard to the ground below while egressing from the roof surface to an A-frame ladder.
