On or about October 20, 2023, Diego Pos John Gilbert DBA John's Renovations LLC did not ensure that employees roofing a residential home approximately 20 feet above the ground were protected from falling by guardrail systems, safety net system, or personal fall arrest systems. Employees were exposed to fall hazards in a worksite at 317 Van Buren Drive in Wentzville, Missouri.

29 CFR 1926.1053(b)(1): When portable ladders had been used for access to an upper landing surface, the ladder side rails had not extended at least 3 feet (.9 m) above the upper landing surface to which the ladder had been used to gain access. On or about October 20, 2023, Diego Pos John Gilbert DBA John's Renovations LLC did not ensure that a portable ladder used to access the roof of a residential home at 317 Van Buren Drive in Wentzville, Missouri extended at least 3 feet above the roof to which employees were accessing. Employees were exposed to fall hazards from utilizing a ladder whose side rails extended approximately 1 foot above the roof, and the point of access to the roof was approximately 20 feet above the ground.

29 CFR 1926.59: The employer had not developed a written hazard communication program in accordance with 29 CFR 1910.1200(e)(1) as incorporated by reference: 29 CFR 1910.1200(e)(1): Employers had not developed, implemented, and maintained at each workplace, a written hazard communication program which at least described how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets (SDSs), and employee information and training would be met. On or about October 20, 2023, Diego Pos John Gilbert DBA John's Renovations LLC had not developed, implemented, and maintained at each workplace a written hazard communication program which at least described how the criteria specified in paragraphs (f) for labeling, (g) for maintaining SDSs, and (h) for employee information and training would be met. Gas was utilized in a worksite at 317 Van Buren Drive in Wentzville, Missouri, to power air compressors for the use of pneumatic nail guns.
