29 CFR  1926.100(a):Employees working in areas where there is a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns, shall be protected by protective helmets.  On or about October 23, 2023, an employees was not provided a hard hat where overhead hazards were present, exposing the employees to a struck-by hazard.  Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR  1926.453(b)(2)(v):A body belt shall be worn and a lanyard attached to the boom or basket when working from an aerial lift. Note to paragraph (b)(2)(v): As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under 1926.502(e).  On or about October 23, 2023, employees were not protected from a fall by a personal fall arrest system while working from an aerial lift, exposing the employees to a fall greater than 25 feet.   Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR  1926.503(a)(1):The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.  On or about October 23, 2023, employees working at heights exceeding six feet were not trained to recognize and minimize fall hazards, exposing the employees to a fall greater than 25 feet.  Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).
