General-duty citation text
29 CFR 1926.1427(f)(1)(i): Through an evaluation, the employer did not ensure that each operator was qualified by a demonstration of the skills and knowledge, as well as the ability to recognize and avert risk, necessary to operate the equipment safely, including those specific to the safety devices, operational aids, software, and the size and configuration of the equipment. Size and configuration includes, but is not limited to, lifting capacity, boom length, attachments, luffing jib, and counterweight set-up: (a) On or about October 20, 2023 and at times prior, the employer did not ensure an operator had been evaluated by the employer and qualified by a demonstration of the skills and knowledge necessary to operate the Grove YB-5518 crane and the ability to avert risk while operating the crane. The operator lifted a load without extending the outriggers, did not accurately program the LMI (Load Moment Indicator) to capture actual lifting configurations and exceeded the capacity of the crane. These factors resulted in the crane overturning, crushing the operator and resulting in fatal injuries.
