29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a) ALN Roofing Restore Carpentry LLC dba Astereo Aldana located at 868 East College Ave Westerville, OH 43081:  On or about October 24, 2023, the employer did not ensure that employees engaged in residential construction activities 6 feet or more above lower level were protected from falls. Roofers were removing/installing shingles on a residential roof that varied from nine to 18 feet without the use of proper fall protection/prevention. The following condition exposed employees to falls of over 18 feet.  b) ALN Roofing Restore Carpentry LLC dba Astereo Aldana located at 868 East College Ave Westerville, OH 43081:  On or about October 24, 2023, the controlling employer did not ensure that sub-contractor employees engaged in residential construction activities 6 feet or more above lower level were protected from falls. Roofers were removing/installing shingles on a residential roof that varied from nine to 18 feet without the use of proper fall protection/prevention. The following condition exposed employees to falls of over 18 feet.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  a. ALN Roofing Restore Carpentry LLC dba Astereo Aldana located at 868 East College Ave Westerville, OH 43081:  On or about October 24, 2023, the employer did not ensure that portable ladders used to gain access to the roof extended at least three feet beyond the upper landing that they were accessing.  One extension ladder was used to gain access to roof of the garage and was positioned approximately 18 inches beyond the upper landing.  The following condition exposed employees/sub-contractor employees to falls of over nine feet.
