29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them:  (a)Black Hills Chopped and Screwed, LLC at Redferen Addition, Box Elder, SD 57719: On or about and at times prior to October 24, 2023, the exposing employer did not ensure an accident prevention program was developed and implemented for the work environment to include regular inspections of the jobsite, materials, and equipment; conducted by a competent person. Employees were conducting framing operations on a single-family residential property without the use of a fall protection system, not using properly installed ladders while accessing and egressing the top plates of framed walls, and a lack of training.  This condition exposed employees to a variety of hazards while working on site.

This condition exposed the employees to fall hazards greater than six feet.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladders side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  (a)Black Hills Chopped and Screwed, LLC at Redferen Addition, Box Elder, SD 57719: On or about and at times prior to October 24, 2023, the exposing employer did not ensure that the Keller 8-foot A-frame step ladder, Part number 100530-52 that the employees were using was extended at least three feet above the upper landing surface of the framed wall top plates of a single-family residential structure.  This condition exposed employees to fall hazards greater than six feet.  (b)Black Hills Chopped and Screwed, LLC at Redferen Addition, Box Elder, SD 57719: On or about and at times prior to October 24, 2023, the exposing employer did not ensure that the Keller 6-foot Aluminum A-frame step ladder, Part Number 120471-01  that the employees were using was extended at least three feet above the upper landing surface of the framed wall top plates of a single-family residential structure.  This condition exposed employees to fall hazards greater than six feet.

29 CFR 1926.1053(b)(13): The top or top step of a stepladder shall not be used as a step:  (a)Black Hills Chopped and Screwed, LLC at Redferen Addition, Box Elder, SD 57719: On or about and at times prior to October 24, 2023, the employer did not ensure that the Keller 6-foot Aluminum A-frame step ladder, Part Number 120471-01, was being utilized properly in that employees were permitted to stand on the top or top step of the stepladder while it was leaning against the west wall of the structure to access the upper areas of the residential property. This condition exposed employees to fall hazards greater than six feet.
