OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees to employees that were exposed to fall hazards: a) At 137 Oak Avenue, Shirley, NY 11967. On or about October 24th, 2023 Employee was exposed to falling 18ft while working from a Werner 24ft extension ladder. The employee was using both hands to control a STIHL chainsaw over his head to cut tree branches. Note: In addition to abatement certification, the employer is required to submit abatement documentation for this item in accordance with 29 CFR 1903.19.

OSH ACT of 1970 Section (5)(a)(1):Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards: a) At 137 Oak Avenue, Shirley, NY 11967. On or about October 24th, 2023 the employer did not establish a drop zone to protect employees from struck-by hazards associated with ground personnel working within the drop zone of falling tree branches. Note: The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.
