29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use: a) Foxx Equipment Company , 955 Decatur St, Unit A, DENVER, CO 80204: On or about October 24th, 2023, and at time's prior, employees were exposed to respiratory hazards when conducting welding operation. The employer did not provide medical evaluations to employees required to use the respirators as required in 1910.134(c)(1)(ii). b) Foxx Equipment Company , 955 Decatur St, Unit A, DENVER, CO 80204: On or about October 24th, 2023, and at time's prior, employees were exposed to respiratory hazards when conducting welding operation. The employer did not provide fit testing procedures for tight-fitting respirators to employees required to use the respirators as required in 1910.134(c)(1)(iii). c) Foxx Equipment Company , 955 Decatur St, Unit A, DENVER, CO 80204: On or about October 24th, 2023, and at time's prior, employees were exposed to respiratory hazards when conducting welding operation. The employer did not provide procedures for proper use of respirators in routine and reasonably foreseeable emergency situations for tight-fitting respirators to employees required to use the respirators as required in 1910.134(c)(1)(iv). d) Foxx Equipment Company , 955 Decatur St, Unit A, DENVER, CO 80204: On or about October 24th, 2023, and at time's prior, employees were exposed to respiratory hazards when conducting welding operation. The employer did not provide procedures for cleaning, disinfecting, storing, inspecting, repairing, discarding, and otherwise maintaining respirators of employees required to use the respirators as required in 1910.134(c)(1)(v). e) Foxx Equipment Company , 955 Decatur St, Unit A, DENVER, CO 80204: On or about October 24th, 2023, and at time's prior, employees were exposed to respiratory hazards when conducting welding operation. The employer did not provide training of employees in the respiratory hazards to which they are potentially exposed during routine and emergency situations for employees required to use the respirators as required in 1910.134(c)(1)(vii). f) Foxx Equipment Company , 955 Decatur St, Unit A, DENVER, CO 80204: On or about October 24th, 2023, and at time's prior, employees were exposed to respiratory hazards when conducting welding operation. The employer did not provide training on putting on, removing, or the limitations of the respirators for employees required to use the respirators as required in 1910.134(c)(1)(viii). g)Foxx Equipment Company , 955 Decatur St, Unit A, DENVER, CO 80204: On or about October 24th, 2023, and at time's prior, employees were exposed to respiratory hazards when conducting welding operation. The employer did not establish work-site specific procedures to regularly evaluate the effectiveness of the program as required in 1910.134(c)(1)(ix).

29 CFR 1910.1026(d)(2)(i):The employer using the scheduled monitoring option did not perform initial monitoring to determine the 8-hour time-weighted average exposure to chromium (VI) for each employee on the basis of a sufficient number of personal breathing zone air samples to accurately characterize full shift exposure on each shift, for each job classification, in each work area: (a) Foxx Equipment Company , 955 Decatur St, Unit A, DENVER, CO 80204: On or about October 24th, 2023, and at times prior, the employer did not determine employees' exposure to chromium (VI) during daily welding operations. Employees conduct welding on stainless steel parts on a semi-regular basis and the employer did not determine the 8-hour TWA exposure to the chromium (VI).

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: a) Foxx Equipment Company , 955 Decatur St, Unit A, DENVER, CO 80204: On or about October 24th, 2023, and at times prior, employees were exposed to chemical hazards while working with chemicals such as but not limited to; Distillates petroleum (Brilliance), Acetone (Lacquer), and d-Limonene (Wham). The employer failed to provide effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area.
