29 CFR  1910.1200(e)(1):The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:  At the jobsite located at 605 Scott Ave. Fort Leavenworth, Kansas, the employer failed to develop a written hazard communication program to describe how the program would be implemented to include proper training, labeling, and the administration of safety data sheets, to address their chemicals and paints such as  Duration Satin Exterior Acrylic Latex paint, which is a skin sensitizer and may cause cancer.

29 CFR  1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area:   At the jobsite located at 605 Scott Ave. Fort Leavenworth, Kansas, employees performing painting activities were exposed to  including but not limited to chemicals and paints such as  Duration Satin Exterior Acrylic Latex paint, which is a skin sensitizer and may cause cancer without being provided with information and training on how to recognize, avoid and/or eliminate the hazards associated with Duration Satin Exterior Acrylic Latex paint.

29 CFR  1910.1200(g)(8):  The employer did not maintain in the workplace copies of the required safety data sheets for each hazardous chemical, and did not ensure that they were readily accessible during each work  shift to employees when they were in their work area(s)  At the jobsite located at 605 Scott Ave. Fort Leavenworth, Kansas, employees performing painting operations were exposed to chemicals and paints such as Duration Satin Exterior Acrylic Latex paint, which is a skin sensitizer and may cause cancer. The employer did not maintain copies of the safety data sheets for  paints used at the site.
