29 CFR  1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   On or about November 2, 2023 the employer Jerusalen Martinez Galiote at jobsite located at 9142 Sylvania Metamora Rd. Sylvania OH 43560, did not ensure employees were protected from falls while conducting residential framing construction activities on the second (roof) level of a new build residential home. Employees were exposed to a falls of 14 feet or greater to the ground below from the roof peak to the ground below. Employees were working atop a roof with an 8:12 pitch.

29 CFR  1926.1053(b)(1):Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  On or about November 2, 2023 the employer Jerusalen Martinez Galiote at jobsite located at 9142 Sylvania Metamora Rd. Sylvania OH 43560, did not ensure the side rails of one portable Werner brand  12-foot fiberglass multi-section extension ladder was extended at least three feet above the landing surface. Employees were exposed to falls from approximately 10 feet or greater from the top of the second (roof) level to the decking below while using the ladder to access the second (roof) level to perform residential construction framing activities.
