29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:  a) Wild English Stoneworks LLC., located at 9312 Ditmas Avenue, Brooklyn, NY 11236  Employees fabricating stone products containing hazardous chemicals such as but not limited to crystalline silica were required to wear 3M 8210 N95 particulate respirators; however, the employer failed to provide medical evaluations by a physician or licensed health care professional (PLHCP) to qualify employees to wear 3M 8210 N95 particulate respirators during cutting, grinding and polishing operations.  Condition observed on or about November 6, 2023.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000.00 AS PER 29 CFR 1903.19.

29 CFR  1910.1053(d)(1):The employer did not assess the exposure of each employee who was or may reasonably be expected to be exposed to respirable crystalline silica at or above the action level in accordance with either the performance option in paragraph (d)(2) or the scheduled monitoring option in paragraph (d)(3) of this section:  a) Wild English Stoneworks LLC., located at 9312 Ditmas Avenue ,Brooklyn, NY 11236  Employees fabricating stone products containing hazardous chemicals such as but not limited to crystalline silica are required to perform stone cutting, grinding and polishing. Employees are working mainly on marble and granite. The employer failed to conduct an exposure assessment to determine the level of employee exposure to crystalline silica during cutting, grinding and polishing operations.   Condition observed on or about November 6, 2023.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000.00 AS PER 29 CFR 1903.19.
