29 CFR  1926.100(a):Employees were not protected by protective helmets while working in areas where there was a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns:  On or about November 7, 2023, and at times prior thereto, the employer did not ensure that employees were wearing hardhats while working below equipment actively hoisting materials during trenching operations, exposing employees to a struck-by hazard from falling objects.

29 CFR 1926.651(e): Employees were not prohibited to be underneath loads handled by lifting or digging equipment.  Employees were not required to stand away from any vehicle being loaded or unloaded to avoid being struck by any spillage or falling materials.  On or about November 7, 2023, and at times prior thereto, employees were permitted underneath loads handled by lifting or digging equipment and below equipment that was actively hoisting wastewater piping materials into a trench, exposing employees to struck-by and crushing hazards from falling objects.

29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees:  On or about November 7, 2023, and times prior thereto, employees were performing work within a trench at a depth of approximately 11 feet without a safe means of egress, exposing employees to the hazard of being engulfed from cave-ins.
