29 CFR  1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:   a) New residential construction on Lot # 207: On or about 11/07/2023, the employer exposed employees to head injury from impact, or from falling or flying objects, hazards while working on a scaffold and throwing bricks to second level of scaffold with no head protection. Employees were not wearing protective helmets where there is a possible danger of head injury from falling objects during brick laying operation.

29 CFR  1926.451(b)(1): Platform(s) on all working levels of scaffolds, were not fully planked or decked between the front uprights and guardrail supports such that the space between adjacent units, and the space between the platform.   a) New residential construction on Lot #207: On or about  11/07/2023, the employer exposed employees to fall hazards of  approximately 13-feet, 6-inches to the lower ground level, in that  the scaffold work platforms were not fully planked to prevent falls to the lower ground level as employees were engaged in masonry activities.

29 CFR  1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section.  a) New residential construction on Lot # 207: On or about 11/07/2023, the employer exposed employees to fall hazards of approximately 13-feet, 6-inches to the lower ground level  while installing siding from a tubular welded scaffold system, in that a fall protection system was not provided to employees engaged in brick installation activities.
